KitKat is doing good in his new home. He has been renamed Taquito and shares his new dad with Rosita who doesn't like him very much so far. Probably a little jealousy going on but they will adapt. New owner reports that nearly all KitKat's fur has grown back over the wound and he is showing no ill effects from his ordeal.
Just in from the Rescue....
"Talked with the DA that's handling KitKat's case a couple of days ago and he will be sending the case to the Grand Jury soon. If they say okay he will be prosecuting the case (Joseph Lupordus) as a felony!!! The DA said it's a strong case since Mr. Lupordus handwrote a confession stating he boiled water and threw it on KitKat because he was upset with him. I could have sat down cried - I want this young man to know and understand how awful it was that he did this to a poor defenseless kitty."
Not only is that sad enough that a man thought to do that but what is possibly worse is that his mother continues to defend him.

His mother defends what he did? He really needs to have the book thrown at him. This wasn't a case of sudden anger and hurting the cat, he took the time to boil the water and then hurt the cat. That shows total premeditation, which is much more extreme. People who do that kind of extreme injury to an animal sometimes move on to hurting people, this guy needs to be removed from society as long as possible so he can't hurt anyone or anything for a very long time.

His mother said it is all being blown out of proportion, that he is really a good guy, that KitKat was at fault for scratching him while trying to get away from the guy etc. etc. etc.
She ain't seen nuthin' yet.

I have a feeling the mother has been making excuses for the sons behavior for a long time and this is just the tip of the iceberg on him. Interesting article I found about it, he even did it in front of witnesses, and they are the ones who reported it. Given we know exactly who raised KitKat and how he was raised and we saw his progress from tiny kitten to adoptable age we all know that is not true. You might want to print out that whole thread about those kittens Kritter and give it to the rescue so they can use it in their defense against this stupid bitch.

The Rescue has already given the D.A. my name and the name of the foster where KitKat and Skittles went for further socialization with her family including two sons who worked with them. Those kittens were never aggressive but went for further socialization with a larger family because they were shy.
The D.A. said that the guy's confession plus statements from the eye witnesses will pretty much sink the guy's ship. Plus even though the KitKat bit the guy (if he really did), there was no excuse to boil water and throw it on him.
The D.A. pretty much thinks the guy will plead out once the charges are officially filed. But, he is ready if the guy doesn't.

I hope they are pushing the premeditation part of the abuse charges, it is an enhancement to the charges that could let them go for harsher charges. He deserves all the punishment they can give him, he is one sick bastard.

Jeez, I thought he had the boiling water handy nearby and it was impulsive. Okay to be cranky when a cat scratches you, but not to get over it in, like, a few seconds? He had to THINK, "I'll throw boiling water on him", then he had to boil the water, then he had to find the cat...nope, something seriously wrong with this guy's brain.
He should be sterilised. Can you imagine this guy around kids?
And HIS MOTHER! The cat's at fault? WTF? She's clearly enabled this guy's psychopathy all along.

When I first heard about this I wondered how this could have occurred to him to be acceptable discipline. I decided that there was a very good chance that this was something he learned in his childhood. After reading the latest developments, I believe this even more.
My heart breaks for Kit Kat and all the other animals that are hurt instead of being treasured. I'm glad Kit Kat is starting a new happy life. I would love it if when this guy dies God appears to him in the form of a cat.

If the Grand Jury won't indite there is not much the courts can do.
Its not the fault of the laws, it is a misfire by a Grand Jury.
If a grand Jury won't indite a person for murder, that doesn't mean that anyone should doubt the law that punishes murderers.

As there were witnesses to KitKat's abuse he can't deny that he did it and it makes it easier for them to charge and convict him.
I have to wonder if he has a juvenile record, too bad those are sealed. This kind of behavior doesn't just start overnight.

He also gave them a written confession as to what happened with what he did to KitKat and why he did it.
I think once he gets indited, he will plead out.
We are hoping for a trial but bet he pleads out.
I am just totally proud that our D. A. is going forward with this to the Grand Jury because we have enough people against people crime here to keep several Grand Jurys busy 24/7.

That vet woman...that's like paedophiles who get jobs in childcare. She should have her licence permanently cancelled. What does she do to a cat or dog in her care who gets scared and bites/scratches her? Torture them a little bit in revenge? Give them a bit too much anaesthetic so they die during an op?
It wasn't even feral, or stray. It was a local cat called Tiger, who was desexed.
I know there's cruelty in the world. What I don't get is the stupidity here, and in KitKat's case.
If you're going to do vile things, you don't do them in front of witnesses, you don't confess, and you certainly don't brag about it on facebook.

I honestly don't get how the Grand Jury couldn't find enough evidence to indict. She bragged about it on her FB account. One year license suspension isn't nearly enough punishment.

Even after her license suspension is lifted, I doubt she will find employment in Texas with that suspension and probation on her state license record.
We are not short staffed on vets in the state and that suspension is going to lower her value anywhere she applies after her probation is lifted.
Texas A&M turns out a large crop of vets every year so the competition for jobs is intense if you want to practice in Texas.

"For all of you that have followed our KitKat's story - I just spoke with the assistant district attorney on the case and was told it was taken to the Grand Jury and a felony indictment has been filed against Mr. Joe Lupardous!!! It is now in the 175th District Court awaiting disposition.
Just a few years ago something like this would have gone unnoticed and a lot of folks would have said "it's just a cat - what's the big deal." Unfortunately we in rescue see way to many awful things that are done to our precious pets and it's wonderful to know that we CAN get some justice for them now!!! I can't tell you what joy it brings to my heart knowing that our little KitKat will now get his justice!!
Just an added note: KitKat's new dad says he's doing great and is very much loved!!"

Hey Kritter do you know if the mother is still suing the foster group for 'persecuting' her son? The mother has taken her threats and disappeared for the time being. She pretty much backed off after she found out that the rescue's husband is an attorney plus being advised that the case was going to a grand jury. The indictment gave her bigger fish to fry. Unknown, we had several cats shot with arrows in the last couple of years but the Texas vet in that incident has no connection with what happened here.

Talked to the rescue about Kenya and she updated me on KitKat.
The asshat was arrested on 12/23 and is now out on a $10,000 bond.
The preliminary hearing is on 1/23 with the trial date of 2/17.
The district attorney is very confident with his prosecution case.
