Hi all,
I sold a bag that was NWT. Buyer opened Not As Described case, claiming one missing bead at back & unraveled handle. I checked my photos & sure enough one bead was missing (bag had disclaimer tag saying handmade, variations etc). Somehow I did not post the photo of the back of the bag in my listing, totally my fault. I did post the back view in the Poshmark listing. I've checked all my photos & cannot see any unraveling of the strap.
For whatever reason, I had a feeling about this & asked her if the tags were still attached. She said no they had come off when she unpacked the item. Not true, the tags were securely attached & the bag was packed in a plastic bag to protect it. She finally admitted that she had removed the tags & therefore I told her I could not accept the return because she had altered the condition.
After a few days she started threatening to call ebay & escalate, however, in order to prevent her from doing so, I could offer her a refund of $35 to 'fix' the bag and she would close the case. (never mind that it's not fixable as they are heat attached beads not sewn on)
I refused and offered her $25--not sure why I did that, I guess I was feeling at the moment I just wanted it to go away. She responded by saying she's too busy to deal with this but will accept $30 when she's less busy. I haven't responded.
It's been quite a few days since that communication & the window to escalate has been open since the 29th.
Last night I called ebay. Despite the fact that the buyer admitted in the messages that she removed the tags, ebay insists they 'need proof'. They told me to send her a return shipping label & once I receive the item, to contact them & let them know the tags were removed, and in that case they would not hold me accountable for the refund. (Meanwhile I'd have both the bag & the money.) What kind of nonsense is that? Can I trust ebay on this? Or will they tell me that I must have removed the tags myself? Not sure what to do here.
Adding to my confusion--after the call, I received an email from ebay saying 'sorry we tried to call you but you didn't answer' etc....meanwhile, I did answer the call back & the rep supposedly read all the messages & documented my concern about the altered condition. Or maybe she didn't usually after these types of callbacks, they send you a message saying 'how did we do'... Not sure if I can trust ebay to support me once I get the bag back, or that I can trust the buyer to close the case if I send her a partial.
What would you do?

It is extremely almost impossible for sellers to win a SNAD case. I lurk on the Sellers Board and the horror stories from sellers make me glad that any of my sales end successfully. I wouldn't depend on ebay having your back after you get the bag back. They will skip the 'he said she said' and defer to the buyer 99% of the time. Those customer service reps will tell you what you want to hear just to get you off the phone. No way is ebay going to let you keep both the item and the money. Your buyer is already being a pain in the butt and even if ebay lost their mind and decided in your favor, she could go straight to her credit card company and file a chargeback with them. I guarantee you will not win that one as ebay will plead that it is out of their hands. She can still go to her credit card if you give her a partial. I would not trust her word on anything as she has already proven to be a liar. You might as well send a return label and hope you get your bag back and not a box of rocks.
On my two recent calls to CS regarding the INR case against me, I received the 'How Did We Do' email both times. I think you CS rep is a lying liar who tells lies.

I would cut my losses, send her a return label, take it back and resell it with full disclosure of any flaws.

Ebay does not care about sellers anymore and more than likely will not have your back. If the seller does a chargeback on her CC, it's another slap in the face when Ebay charges you $20 for that.

Supposedly that fee is only if the seller is found responsible for the buyer doing a chargeback, but from what I've heard and read Ebay finds against the seller 99.99% of the time.

A seller never wins because ebay backs out of the process. The seller is apparently given one shot to prove their case in a very restricted manner such as one pic. Some sellers have done a type of collage of a pic of the item, pic of the Delivery Confirmation, and typed response and still lost. The credit card company is going to side with their customer, ebay is going to stay on the sidelines, and the seller is screwed.
Paypal also charged the seller the $20 if they lost a chargeback so this is nothing new.
Apparently once a chargeback is filed, Ebay considers it out of their hands and the credit card company takes over and decides the outcome. To add insult to injury, the credit card company does not require the buyer to send the item back to the seller so the seller is out the item, the sale proceeds, and the $20.

I'd tell her to return it and that you will refund thru eBay upon receipt, then deduct however much you can for the tags being removed, based on what Emerald posted above.

Lurking on the Seller's Board is pretty scary. Apparently there are videos on the web showing people how to get stuff for free from ebay sellers.
Some categories are hit more and harder than other categories but there are some big losses for sellers.
