I'm so glad KitKat is going to a caring home with another cat to be with. That should make his transaction easier and hopefully he will be able to trust and love again.

The poor darling. I hope this man is very patient and sensitive. And that his residence looks/smells nothing like that cruel jerk's place. With that and a kitteh friend, KitKat should do well.

I think he will be fine. I am sure the rescue checked this guy up one side and down the other before she released KitKat to him.
I hope he gives the rescue updates on how KitKat is doing. I am sure he knows that we are all emotionally invested in this cat.
Thank goodness the case is going forward in the justice system.

Petti, It depends on what the DA charges the guy with as to the penalty and if he has been charged and convicted with animal abuse in the past.
Texas has really toughened up on animal abuse since we got the laws upgraded several years ago. The poor legislatures in Austin really had their feet put to the fire with the organized campaign that we put forth. Phone calls to the our reps in Austin several times a day plus people busing to Austin to sit in the audience. Mucho publicity as well. It was a well earned victory.
I can guarantee that the courtroom will be packed when this guy goes to trial and/or gets sentenced if he pleads guilty without a trial.

Kritter, if there are a lot of people going to court for this case you might want to get a bunch of those big picture buttons made up with a pic of KitKat and each wear one. It's a good silent way to show the court your solidarity and feelings on the case.

Good idea. I will mention it to the rescue.
I am thinking that this guy is going to try and plead out to this so no publicity. It would be a good idea because we intend on having the media there for sure.

He'll have to plead, won't he? What possible defence could there be other than genuinely not knowing any better - ie a very low IQ?

If the area courts are overloaded, he could get a deal where he pled guilty and only gets community service time or a minimal fine. Happens all the time, MissP. Animal cuelty is a petty issue to some legal folks.

I doubt there is any defense since there were several witnesses that came forward plus they have the statement from the animal control office where the clown stated exactly what he did and signed it.
I doubt it will go to trial but it will not be swept under the rug either because the animal friendly people here are now a force to be reckoned with unlike in other cities and the legal folks here feel the pressure.
I think he will plead guilty and probably pay a fine if this is his first offense. The main thing is getting it on his record so if something like this happens with him again, the penalty will be more severe under the current laws.
